END-USER LICENSE AGREEMENT

This End-User License Agreement (EULA) is a legal agreement between CM&V Hackbart and the user (“licensee”) of the DVBViewer Trial.
"DVBViewer Trial" refers to a version of the DVBViewer Pro to be used only to review, demonstrate and evaluate the Software for a limited time period.
This DVBViewer Trial is both time- and feature-limited and provided free of charge. A detailed description of these restrictions is available at [link].

The DVBViewer Trial is not shareware and cannot be unlocked. It’s sole purpose is for evaluation before the purchase of the DVBViewer Pro. You can try before you buy.
Although the DVBViewer Trial is free of charge, this does not mean that there are no conditions for using it. This software is copyrighted and CM&V Hackbart as owner of the copyright claims all exclusive rights to such software.

By installing, copying, or otherwise using the DVBViewer Trial the licensee agrees to be bound by the terms of this EULA. If the licensee does not agree to the terms of this EULA, the licensee must not install or use the DVBViewer Trial

1. Terms

When used in this EULA, the following terms shall have the respective meanings indicated, such meanings to be applicable to both the singular and plural forms of the terms defined:

"Licensor" means CM&V Hackbart.

2. GENERAL USE 

As long as the licensee complies with the terms of this EULA, the licensor grants the licensee a non-exclusive right to use the DVBViewer Trial under the following conditions:

• The software may be installed and used by the licensee for the sole purpose of determining whether to purchase a license for the DVBViewer Pro. 
• The software may be installed and used by the licensee on any number of systems.
• The software can be copied and distributed on condition that the original copyright notice and disclaimer of warranty stay intact and the licensee does not charge money or fees for the DVBViewer Trial.
• The licensee's distribution of the DVBViewer Trial will not entitle him/her to any compensation from the licensor.
• The licensee may not rent, lease, or lend the software to anyone.
• The licensee may permanently transfer all of his/her rights under this EULA, provided the recipient agrees to the terms of this EULA.
• Without prejudice to any other rights, the licensor may terminate this EULA if the licensee fails to comply with the terms and conditions of this EULA. In such event, the licensee must destroy all copies of the software.

3. INTELLECTUAL PROPERTY RIGHTS

3.1 This license does not transmit any intellectual rights on the software. The DVBViewer Trial and any copies that the licensee is authorized by the licensor to make are the intellectual property of and are owned by CM&V Hackbart. 
3.2 The software is protected by copyright, including without limitation by copyright law and international treaty provisions. 
3.3 Any copies that the licensee is permitted to make pursuant to this EULA must contain the same copyright and other proprietary notices that appear on or in the software. 
3.4 The structure, organization and code of the software are the valuable trade secrets and confidential information of the CM&V Hackbart. The licensee agrees not to decompile, disassemble or otherwise attempt to discover the source code of the software.
3.5 Any attempts to reverse-engineer, copy, clone, modify or alter in any way the installer program without the licensor's specific and written approval are strictly prohibited. The licensee is not authorized to use any plug-in or enhancement that permits to save modifications to a file with software licensed and distributed by the licensor.
3.6 Any information supplied by the licensor or obtained by the licensee, as permitted hereunder, may only be used by the licensee for the purpose described herein and may not be disclosed to any third party or used to create any software which is substantially similar to the expression of the software.
3.7 Trademarks shall be used in accordance with accepted trademark practice, including identification of trademarks owners' names.

4. WARRANTY

4.1 The licensor warrants that:
4.1.1 CM&V Hackbart owns the software and documentation and/or is in possession of valid and existing licenses that support the terms of this EULA;
4.1.2 to the best of the licensor's knowledge, the DVBViewer Trial does not infringe upon or violate any intellectual property right of any third party;
4.1.3 the DVBViewer Trial does not contain any back door, time bomb, drop dead device or other routine intentionally designed by the licensor to disable a computer program, or computer instructions that alter, destroy or inhibit the processing environment.

4.2 Except those warranties specified in section 4.1 above, the software is being delivered to the licensee "AS IS" and the licensor makes no warranty as to its use or performance.

CM&V Hackbart does not and cannot warrant the performance or results the licensee may obtain by using the software. The entire risk arising out of use or performance of the software remains with the licensee.

The licensor gives no warranty, express or implied, that (i) the software will be of satisfactory quality, suitable for any particular purpose or for any particular use under specified conditions, notwithstanding that such purpose, use, or conditions may be known to the licensor; or (ii) that the software will operate error free or without interruption or that any errors will be corrected.

5. LIMITATION OF LIABILITY

In no event will the licensor be liable for any damages, claims or costs whatsoever or any consequential, indirect, incidental damages, or any lost profits or lost savings, even if the licensor has been advised of the possibility of such loss, damages, claims or costs or for any claim by any third party. 

In no event will the licensee be liable to the licensor on condition that the licensee complies with all terms and conditions stated in this License.

6. NON-WAIVER

If a portion of this EULA is held unenforceable, the remainder shall be valid. It means that if one section of the EULA is not lawful, the rest of the EULA is still in force. A party's failure to exercise any right under this agreement will not constitute a waiver of (a) any other terms or conditions of this EULA, or (b) a right at any time thereafter to require exact and strict compliance with the terms of this EULA.

Diese EULA (End User License Agreement/Endbenutzerlizenz) ist ein Vertrag zwischen

CM&V Hackbart, Schubertstraße 23, 99096 Erfurt,

Lizenzgeber,

und der/dem

Nutzer/in des DVBViewer Trial,
Lizenznehmer.

Der DVBViewer Trial ist eine spezielle Version des DVBViewer Pro, die aus­schließlich Demonstrations- und Testzwecken des Produktes für einen beschränkten Zeitraum dient. Diese Software ist sowohl zeitlich als auch funktionell gegenüber dem DVBViewer Pro eingeschränkt und wird unentgeltlich zur Verfügung gestellt. Eine detaillierte Übersicht dieser Beschränkungen können unter [Link] eingesehen werden.
Beim DVBViewer Trial handelt es sich nicht um freischaltbare Shareware, die gegenüber dem DVBViewer Pro fehlenden Funktionen bzw. Programmteile wurden nicht im Programmcode implementiert. Der einzige Zweck dieser Trial Software besteht darin, dem Kunden die Möglichkeit zu geben, sich vor dem Kauf eingehend zu informieren.
Obwohl der DVBViewer Trial kostenlos zur Verfügung gestellt wird, ist die Benutzung an die folgenden Bedingungen geknüpft. Das Urheberrecht liegt ausschließlich bei CM&V Hackbart.
Mit dem Herunterladen, der Installation, der Vervielfältigung oder sonstigen Ge­brauch der Software stimmt der Lizenznehmer vorbehaltlos den Bedingungen dieses Vertrages zu. Sollte der Lizenznehmer mit diesen Bedingungen nicht einverstanden sein, so ist der Gebrauch generell untersagt.

1. Begrifflichkeiten

Die in diesem Vertrag verwendeten Begriffe haben die folgende Bedeutung:
„DVBViewer Trial“ bzw. „Software“ beziehen sich auf alle Programmteile, denen dieser Vertrag beiliegt. Darunter fallen u. a. Registrierungsinformationen, d. h. einen Lizenzschlüssel, der auf dem Namen des Lizenznehmers basiert, jegliche bei­liegende Dokumentation/Anleitung sowie Installationsdateien.
Benutzung bzw. Gebrauch bezieht sich auf den Zugang, den Download, die Installation, die Vervielfältigung oder sonstige Ziehung von Gebrauchsvorteilen in Übereinstimmung mit der Dokumentation/Anleitung.

2. Allgemeiner Gebrauch 

Solange der Lizenznehmer die Bedingungen dieses Vertrages respektiert, erteilt CM&V Hackbart die nicht-ausschließliche Lizenz zur Nutzung des DVBViewer Trial unter den folgenden Bedingungen:

• Die Software darf vom Lizenznehmer ausschließlich verwendet werden, um sich ein Bild der Möglichkeiten und Funktionen des Programms vor dem Kauf des DVBViewer Pro zu machen.
• Der Lizenznehmer darf die Software auf einer beliebigen Anzahl von Systemen installieren.
• Die Software darf nur vollständig, d. h. inklusive dieses Vertrages, kopiert und weitergegeben werden. Dies muss unentgeltlich geschehen.
• Die Weitergabe des DVBViewer Trial berechtigt den Lizenznehmer nicht dazu vom Lizenzgeber eine Vergütung zu verlangen.
• Die Software darf nicht im Rahmen eines Miet- oder Leasingvertrages weitergegeben werden.
• Sollte der Lizenznehmer gegen die Bedingungen dieses Vertrages verstoßen, so erlischt die erteilte Lizenz und alle Kopien der Software müssen vernichtet werden.

3. Urheberrecht

• Diese Lizenz überträgt keine Urheber- oder Markenrechte an der Software. Das Urheberrecht bzw. Markenrecht für den DVBViewer Trial und alle Kopien, die der Lizenznehmer anfertigt, verbleibt bei CM&V Hackbart.
• Die Software darf in keiner Weise verändert werden, insbesondere dürfen keine Urheberrechts- und/oder Markenhinweise entfernt werden.
• Jegliche Dekompilierung oder Disassemblierung oder sonstige Methode, an den Source-Code des DVBViewer Trial zu gelangen, ist untersagt.
• Ebenso wenig darf die Installationsroutine nicht dekompiliert bzw. disassembliert oder kopiert oder verändert werden.
• Keine Information, die dem Lizenznehmer vom Lizenzgeber zur Verfügung gestellt wird oder die der Lizenznehmer auf sonstige Weise erlangt, darf Dritten zugänglich gemacht werden oder zur Erstellung eines direkten Konkurrenzproduktes zum DVBViewer Pro/Trial verwendet werden.

4. Garantie/Mängelhaftung

Der Lizenzgeber stellt den DVBViewer Trial unter Berücksichtigung der im Verkehr erforderlichen Sorgfalt zur Verfügung.
Jede Haftung für Sach- oder Rechtsmängel sowie eine Garantie, egal ob ausdrücklich oder konkludent, insbesondere für die Eignung für einen bestimmten Zweck und/oder Fehlerfreiheit, ist ausgeschlossen.

5. Haftungsausschluss

Mit Ausnahme der Haftung für Schäden aus der Verletzung von Leben, Körper und Gesundheit, die auf einer fahrlässigen oder vorsätzlichen Pflichtverletzung beruhen, sind weitergehende Ansprüche des Lizenznehmers – unabhängig vom Rechtsgrund - ausgeschlossen, soweit nicht ausdrücklich etwas anderes vereinbart wurde.
Der Lizenzgeber haftet deshalb nicht für Schäden, die nicht am Liefergegenstand unmittelbar entstanden sind;  insbesondere haftet er nicht für entgangenen Gewinn oder sonstige Vermögensschäden des Lizenznehmers.
Vorstehende Haftungsbefreiung gilt nicht, sofern der Schaden auf Vorsatz, grober Fahrlässigkeit oder Fehlen einer zu­ge­sicherten Eigenschaft, Verletzung vertragswesentlicher Pflichten, Leistungsverzug, Unmöglichkeit, sowie Ansprüchen nach §§ 1, 4 des Produkthaftungsgesetzes beruht.
CM&V Hackbart haftet nicht für die Wiederherstellung von Daten, es sei denn, dass wir den Verlust vorsätzlich oder grob fahrlässig verursacht haben und der Lizenznehmer sichergestellt hat, dass eine Datensicherung erfolgt ist, so dass die Daten mit vertretbarem Aufwand rekonstruiert werden können.

6. Salvatorische Klausel

Dieser Vertrag stellt das vollständige Bedingungswerk zum Gebrauch des DVBViewer Trial dar. Es hat Vorrang gegenüber allen anderen schriftlichen oder mündlichen Vereinbarungen. Soweit eine Bestimmung dieses Vertrages für nichtig, unwirksam oder nicht durchsetzbar ist, bleiben die übrigen Bestimmungen weiterhin vollständig wirksam.
